Terms of Use

These Terms of Use ("Terms") are a legal agreement between you ("you", "your", "User") and Reflexia ("Reflexia", "we", "us", "our") concerning your access to and use of the Reflexia mobile application for iOS, including any updates and accompanying materials (the "App").

By installing, opening or using the App, you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy. If you do not agree, please do not install or use the App.

1. Important notice — Reflexia is not medical advice

The App is a self-care, wellness and journaling tool. It is not a medical device, not a substitute for professional advice, diagnosis or treatment, and not a crisis service.

Content shown in the App (including AI-generated insights, breathing exercises, meditation prompts and inspirational quotes) is provided for general informational and self-reflection purposes only.
Reflexia does not make any diagnosis. Mood scores, statistics and AI insights are not clinical assessments and should not be relied upon as such.
Never disregard professional medical advice or delay seeking it because of something you have read or seen in the App.

REFLEXIA IS NOT A REPLACEMENT FOR THERAPY OR MEDICAL CARE. THE APP DOES NOT DIAGNOSE, TREAT, CURE OR PREVENT ANY DISEASE OR CONDITION. ONLY A LICENSED PHYSICIAN, PSYCHOLOGIST OR OTHER QUALIFIED HEALTHCARE PROVIDER CAN DO THAT.

IF YOU HAVE BEEN DIAGNOSED WITH A MENTAL HEALTH CONDITION, ARE TAKING PSYCHIATRIC MEDICATION, OR ARE OTHERWISE UNDER PROFESSIONAL CARE, PLEASE CONSULT YOUR HEALTHCARE PROVIDER BEFORE RELYING ON ANY CONTENT IN THE APP, INCLUDING AI-GENERATED INSIGHTS, BREATHING EXERCISES OR MEDITATIONS.

By installing or using the App, you confirm that you have read and understood this notice and that you accept the App's nature as a self-care tool rather than a medical service.

2. Eligibility

You may use the App only if all of the following are true:

You are at least 13 years old, or the higher minimum age required by your country (for example, 16 in some EU Member States, where applicable). If you are below the age of majority in your country, you confirm that your parent or legal guardian has reviewed and accepted these Terms on your behalf.
You have the legal capacity to enter into a binding contract under the laws applicable to you.
You are not located in, under the control of, or a national or resident of any country subject to a comprehensive embargo by your country of residence, and you are not on any government list of restricted parties.
You comply with all applicable laws.

If you do not meet these requirements, you must not use the App.

3. The licence we grant you

Subject to your compliance with these Terms, Reflexia grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to download and use one copy of the App on an iOS device that you own or control, for your personal, non-commercial use.

This licence is granted under Apple's standard end-user licence agreement (EULA) for App Store applications. See Section 12 ("Apple-specific terms") below.

This licence does not give you any right to:

copy, modify, translate, adapt or create derivative works of the App;
reverse engineer, decompile, disassemble or attempt to derive the source code of the App, except to the extent that this restriction is prohibited by applicable law;
remove, obscure or alter any proprietary notices on the App;
rent, lease, lend, sell, redistribute, sublicense or otherwise transfer your rights in the App;
use the App in connection with any commercial offering of your own, including a paid coaching or therapy service, without our prior written permission;
use any automated means to access the App or extract data from it;
bypass any technical limitations or security measures, including the encryption of your data on the device.

We reserve all rights not expressly granted to you.

4. Your account and your data

The App does not require you to register an account. There is no sign-up, no password, and no server-side profile.

All of the data you create in the App — your journal entries, mood logs, audio and video recordings, photos and profile fields — is stored on your device, in an encrypted local database. You are responsible for:

the device on which the App is installed (including its lock screen, passcode and biometric protection);
making your own backups if you wish to preserve your data — for example by using the in-App Export function (Profile → Backup → Export);
the content you create in the App.

Uninstalling the App, restoring your device, or resetting the App from Profile → Backup → Reset will permanently delete your local data. We cannot recover it.

5. User content and ownership

"User Content" means everything you create in the App: journal entries, titles, text, audio recordings, video recordings, photos, mood entries, profile fields, and exported archives.

You own your User Content. We claim no ownership in it.
Because your User Content is stored on your device and is not uploaded to our servers, we do not need a licence to your User Content to operate the App, and you do not grant us one.
You are solely responsible for your User Content and for any consequences of creating or sharing it (for example, if you export it and send it to another person).

You agree not to use the App to create or store content that:

is unlawful, defamatory, obscene, harassing, threatening, hateful or otherwise objectionable;
infringes the intellectual property, privacy or other rights of any other person;
contains malware or harmful code.

Since the App does not transmit your User Content to us, our ability to enforce this rule is limited; however, if it comes to our attention that the App is being used for unlawful purposes, we may suspend access to features or take other appropriate measures.

6. AI Insights and third-party AI providers

The App includes an optional AI Insights feature.

The feature sends only aggregated mood statistics (such as your 7-day and 30-day average mood, dominant mood label and entry counts, plus your device language) to the AI provider you select. Your journal text, titles, audio, video and photos are never sent. A full description is in the Privacy Policy, Section 3.2.
If you do not configure your own provider, the App uses the Default provider — which is Google's Gemini API, accessed under an API key owned by Reflexia. Reflexia does not operate its own AI model; the underlying intelligence is Google's. By using AI Insights with the Default provider you acknowledge that your aggregated mood statistics are processed by Google under Google's Generative AI terms.
If you provide your own API key (OpenAI, Google Gemini or Anthropic Claude):
- You are responsible for compliance with that provider's terms of service and for any fees or quotas associated with your account.
- The request is processed under your account with that provider; your relationship is directly with them.
- You are responsible for keeping your API key secret. The App stores the key in the iOS Keychain and we never see it, but if the device is unlocked the key can be read by your AI provider settings screen inside the App.
AI output is not advice. AI-generated insights are produced by a third-party language model. They may be inaccurate, incomplete or inappropriate. You must use independent judgement before relying on any AI Insight. The disclaimer in Section 1 applies in full.
You can disable the AI Insights widget at any time in Profile → Widgets, in which case no AI requests will be made.

7. Permissions on your device

The App will ask for the following permissions, only when you trigger a feature that needs them: Camera, Microphone, Photo Library, Notifications, and Face ID / Touch ID / Passcode.

You can grant, deny or revoke each permission at any time in iOS Settings → Reflexia. Some features (for example, recording a voice journal) will not work without the corresponding permission.

The App does not ask for: HealthKit, Location, Contacts, Calendar, Motion & Fitness, Bluetooth, or App Tracking Transparency (we do not perform cross-app tracking).

8. Updates, changes and availability

We may release updates to the App from time to time. Updates may add, modify or remove features, and may require the latest supported version of iOS. You may need to install updates to keep using the App or to continue receiving security fixes.
We may modify or discontinue the App, in whole or in part, at any time, for example for technical, legal or security reasons. We will use reasonable efforts to warn you of material changes in advance.
The App may be temporarily unavailable because of maintenance, technical issues, third-party outages (such as an AI provider outage), or events beyond our reasonable control. The App will continue to function for its local features (journal, mood tracking) even when AI Insights are unavailable.

9. Fees

The App is currently offered free of charge. In the future we may introduce paid features, most likely as an App Store subscription, to support continued development and unlock additional capabilities (for example, deeper AI insights or premium meditation content). Where we do, the additional terms applicable to those features will be presented inside the App and you will need to agree to them separately before being charged anything.

Features that are free today will remain free. We will not retroactively move existing functionality behind a paywall, and you will always retain access to the journal entries, mood logs, recordings and other content you have already created — with or without any future subscription.

All payments for any future paid features will be processed by Apple through the App Store, under Apple's standard payment terms. We will not receive your card or bank details — see Section 6.5 of the Privacy Policy for what we do and do not see about a purchase.

10. Intellectual property

The App and all of its components — including its source code, user interface, designs, logos, trademarks (including the "Reflexia" name and logo), text, graphics, sounds, illustrations, breathing patterns, meditation prompts and inspirational quotes selected and curated by us — are owned by Reflexia or its licensors and are protected by intellectual property laws.
Except for the limited licence in Section 3, no rights in the App are transferred to you.
Third-party components included in the App (for example, open-source libraries) are licensed under their own terms, which we honour. A list of these components and their licences is available on request.

11. Prohibited conduct

In addition to the restrictions in Section 3, you agree that you will not, and will not allow any third party to:

use the App to violate any law or regulation;
impersonate any person or misrepresent your affiliation with any person or organisation;
use the App in a way that could disable, overburden or impair the operation of our or any third party's systems;
attempt to gain unauthorised access to the App, to any third-party API, or to data of other users (although there are no other users on a server, you should not attempt to interfere with any other person's device);
use the App to generate, store or transmit content that exploits or endangers minors;
use the App in any way that, in our reasonable judgement, is harmful or abusive.

We may suspend or terminate your access to features (for example, the Default AI provider) if you breach this Section.

12. Apple-specific terms

These Terms are between you and Reflexia, not Apple Inc. Apple is not responsible for the App or its content. The following terms apply to your use of the App and prevail over any inconsistent provision elsewhere in these Terms:

Scope of the licence. The licence granted to you in Section 3 is limited to a non-transferable licence to use the App on any iOS device that you own or control, as permitted by the Apple Media Services Terms and Conditions.
Maintenance and support. Reflexia is solely responsible for providing any maintenance and support for the App. Apple has no obligation whatsoever to provide maintenance or support.
Warranty. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
Product claims. Reflexia, not Apple, is responsible for addressing any claims you or any third party may have relating to the App, including (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
Intellectual property. In the event of any third-party claim that the App or your possession and use of it infringes a third party's intellectual property rights, Reflexia, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such infringement claim.
Compliance with laws. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party beneficiary. You acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

13. Disclaimer of warranties

To the maximum extent permitted by applicable law, the App is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied or statutory.

Reflexia does not warrant that:

the App will meet your requirements;
the App will be uninterrupted, timely, secure or error-free;
the results obtained from the App, including AI Insights, will be accurate or reliable;
any errors in the App will be corrected.

You use the App at your own risk. To the extent that any warranty cannot be excluded under applicable consumer law, our liability is limited to the minimum permitted by that law.

14. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Reflexia, its affiliates, officers, employees, agents or licensors be liable to you for any:

indirect, incidental, special, consequential, exemplary or punitive damages;
loss of profits, revenue, goodwill, data or use;
damages resulting from your reliance on AI Insights or other in-App content;
damages resulting from loss of data caused by your uninstalling the App, resetting it, losing your device, or failing to make backups,

even if Reflexia has been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, Reflexia's total cumulative liability to you arising out of or related to the App or these Terms will not exceed the greater of (a) the amount you have paid to us for the App in the twelve months preceding the event giving rise to the liability, or (b) USD 50.

Nothing in these Terms limits or excludes: (i) liability for death or personal injury caused by negligence; (ii) liability for fraud or fraudulent misrepresentation; or (iii) any other liability that cannot be limited or excluded under applicable law (including, in some jurisdictions, consumer rights).

15. Indemnification

You agree to indemnify and hold harmless Reflexia and its affiliates, officers, employees and agents from and against any claim, liability, damage, loss or expense (including reasonable legal fees) arising out of or in connection with: (a) your misuse of the App; (b) your violation of these Terms; (c) your violation of any law or of the rights of any third party; or (d) your User Content. This Section does not apply where prohibited by applicable consumer law.

16. Termination

By you. You may stop using the App and uninstall it at any time. Uninstalling the App deletes all of your local data.
By us. We may suspend or terminate your access to the App, or to specific features (such as the Default AI provider), if you materially breach these Terms or if we are legally required to do so. Where reasonably possible we will give you advance notice.
Sections that by their nature should survive termination — including Sections 5 (User Content), 10 (Intellectual property), 13 (Warranties), 14 (Liability), 15 (Indemnification), 17 (Governing law) and 18 (Miscellaneous) — will survive.

17. Governing law and dispute resolution

The governing law and forum for these Terms depend on where you are located.

17.1 If you are located in the United States

These Terms are governed by the laws of the State of [US STATE — e.g. California] and of the United States, without regard to choice-of-law or conflict-of-laws principles. You and Reflexia agree that any dispute arising out of or relating to these Terms or the App will be resolved exclusively in the state or federal courts located in [US COUNTY, US STATE], and you submit to the personal jurisdiction of those courts. You agree that any dispute will be resolved on an individual basis and that you waive any right to participate in a class action, to the extent permitted by law. Nothing in this Section prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

17.2 If you are located outside the United States

These Terms are governed by the laws of [GOVERNING LAW JURISDICTION — e.g. Ukraine], without regard to its conflict-of-laws principles. Any dispute will be brought before the competent courts of [COURTS — e.g. Kyiv, Ukraine], unless otherwise required by mandatory law in your country of residence.

17.3 Consumer protection (mandatory rights preserved)

If you are a consumer resident in the European Economic Area, the United Kingdom, Switzerland or any other jurisdiction that grants you the benefit of mandatory consumer-protection rules of your country of residence, those mandatory rules continue to apply and these Terms do not deprive you of them. You may bring proceedings in the courts of your country of residence, and we may bring proceedings against you only in the courts of your country of residence.

17.4 Informal resolution first

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at reflexia.support@gmail.com. We will try to resolve any dispute through good-faith negotiation within 60 days of your notice. If we cannot, either party may bring proceedings as set out above.

18. Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Reflexia regarding the App.
Changes. We may update these Terms from time to time. When we do, we will update the "Effective date" and "Last updated" at the top of this document. For material changes — such as a change in the categories of data we send to third parties, the introduction of paid features, a new jurisdictional clause, or a change that materially reduces your rights — we will present the updated Terms on the Consent screen at the next App launch and require you to affirmatively re-accept before continuing to use any affected feature. For non-material updates (typographical fixes, clarifications, organisational changes), continued use of the App after the update constitutes acceptance.
Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
No waiver. A failure to enforce a provision does not waive our right to enforce it later.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition or sale of assets.
Force majeure. Neither party will be liable for any delay or failure to perform caused by events beyond its reasonable control.
Language. These Terms are provided in English. Translated versions are for convenience; the English version prevails in case of inconsistency, except where local law requires otherwise.

Reflexia не ставить діагнозів. Mood-бали, статистики та AI-інсайти не є клінічними оцінками і не повинні на них покладатися.
Ніколи не нехтуйте професійною медичною порадою і не відкладайте звернення за нею через щось, що ви прочитали чи побачили в Застосунку.

2. Право користування

Ви можете користуватись Застосунком лише за умови, що всі наступні твердження правдиві:

Вам щонайменше 13 років, або вищий мінімальний вік, передбачений законодавством вашої країни (наприклад, 16 у деяких країнах ЄС). Якщо ви не досягли повноліття у своїй країні, ви підтверджуєте, що ваші батько/мати чи законний представник переглянули та прийняли ці Умови від вашого імені.
Ви маєте правоздатність укласти зобов'язуючий договір згідно з законодавством, що до вас застосовується.
Ви не перебуваєте в, не контролюєтесь, не є громадянином чи резидентом країни, що підпадає під всеосяжне ембарго з боку вашої країни проживання, і не внесені в жоден урядовий список обмежених осіб.
Ви дотримуєтесь усіх застосовних законів.

Якщо ви не відповідаєте цим вимогам, ви не повинні користуватись Застосунком.

3. Ліцензія, яку ми вам надаємо

За умови дотримання вами цих Умов, Reflexia надає вам обмежену, персональну, відкличну, неексклюзивну, непередавану, без права субліцензування ліцензію на завантаження та використання однієї копії Застосунку на iOS-пристрої, яким ви володієте чи контролюєте, для особистого, некомерційного користування.

Цю ліцензію надано в межах стандартної EULA Apple для застосунків App Store. Див. Розділ 12 ("Умови Apple") нижче.

Ця ліцензія не дає вам права:

копіювати, модифікувати, перекладати, адаптувати чи створювати похідні твори на основі Застосунку;
здійснювати реверс-інжиніринг, декомпіляцію, дизасемблювання чи спроби отримати вихідний код Застосунку, за винятком випадків, коли це обмеження заборонене законом;
видаляти, приховувати чи змінювати будь-які повідомлення про права власності;
здавати в оренду, лізинг, позичати, продавати, перерозподіляти, субліцензувати чи інакше передавати свої права в Застосунку;
використовувати Застосунок у поєднанні з власним комерційним продуктом, включно з платним коучингом чи терапевтичною послугою, без нашої попередньої письмової згоди;
використовувати будь-які автоматизовані засоби для доступу до Застосунку чи отримання даних із нього;
обходити будь-які технічні обмеження чи заходи безпеки, включно з шифруванням ваших даних на пристрої.

Усі права, прямо вам не надані, ми залишаємо за собою.

4. Ваш обліковий запис та ваші дані

Застосунок не вимагає реєстрації облікового запису. Немає реєстрації, паролю, серверного профілю.

Усі дані, які ви створюєте в Застосунку — записи журналу, mood-логи, аудіо та відео, фото та поля профілю — зберігаються на вашому пристрої в зашифрованій локальній базі. Ви відповідаєте за:

пристрій, на якому встановлено Застосунок (включно з блокуванням екрану, паролем і біометричним захистом);
створення власних резервних копій, якщо ви хочете зберегти дані — наприклад, через функцію Export у Застосунку (Profile → Backup → Export);
контент, який ви створюєте в Застосунку.

Видалення Застосунку, відновлення пристрою чи скидання Застосунку через Profile → Backup → Reset остаточно видаляє ваші локальні дані. Ми не можемо їх відновити.

5. Контент користувача та право власності

"Контент користувача" — це все, що ви створюєте в Застосунку: журнальні записи, заголовки, текст, аудіо- та відеозаписи, фото, mood-записи, поля профілю та експортовані архіви.

Контент користувача належить вам. Ми не претендуємо на жодну власність на нього.
Оскільки ваш Контент зберігається на вашому пристрої й не завантажується на наші сервери, нам не потрібна ліцензія на ваш Контент для роботи Застосунку, і ви її нам не надаєте.
Ви несете повну відповідальність за свій Контент та за будь-які наслідки його створення чи поширення (наприклад, якщо ви експортуєте та надсилаєте його іншій особі).

Ви погоджуєтесь не використовувати Застосунок для створення чи зберігання контенту, який:

є незаконним, наклепницьким, непристойним, агресивним, погрозливим, ворожим чи в інший спосіб неприйнятним;
порушує інтелектуальну власність, приватність чи інші права будь-якої особи;
містить шкідливий код.

6. AI Insights та сторонні AI-провайдери

Застосунок містить опціональну функцію AI Insights.

Функція надсилає лише агреговані mood-статистики (середній бал настрою за 7 та 30 днів, переважна мітка настрою та кількість записів, плюс мова пристрою) обраному AI-провайдеру. Ваш журнальний текст, заголовки, аудіо, відео та фото ніколи не надсилаються. Повний опис у Політиці конфіденційності, Розділ 3.2.
Якщо ви не налаштували власного провайдера, Застосунок використовує дефолтний провайдер — це Google Gemini API, до якого ми звертаємось через API-ключ, що належить Reflexia. Reflexia не має власної AI-моделі; справжня "розумна" частина — це Google. Використовуючи AI Insights із дефолтним провайдером, ви визнаєте, що ваші агреговані mood-статистики обробляє Google згідно з Google Generative AI Terms.
Якщо ви надаєте власний API-ключ (OpenAI, Google Gemini або Anthropic Claude):
- Ви відповідаєте за дотримання умов сервісу цього провайдера та за будь-які збори або квоти, пов'язані з вашим обліковим записом.
- Запит обробляється під вашим обліковим записом у цього провайдера; ваші стосунки виникають безпосередньо з ним.
- Ви відповідаєте за збереження вашого API-ключа в таємниці. Застосунок зберігає ключ у iOS Keychain і ми його ніколи не бачимо, але якщо пристрій розблоковано, ключ можна побачити в налаштуваннях AI-провайдера в Застосунку.
AI-вивід не є порадою. AI-інсайти створюються сторонньою мовною моделлю. Вони можуть бути неточними, неповними чи невідповідними. Ви маєте керуватись власним судженням перед тим, як покладатися на будь-який AI Insight. Застереження з Розділу 1 діє в повному обсязі.
Ви можете вимкнути віджет AI Insights у будь-який час у Profile → Widgets, і тоді жодні AI-запити не надсилатимуться.

7. Дозволи на вашому пристрої

Застосунок запитуватиме наступні дозволи лише тоді, коли ви запускаєте функцію, яка їх потребує: Камера, Мікрофон, Фотобібліотека, Сповіщення, Face ID / Touch ID / Passcode.

Ви можете надати, відмовити чи відкликати кожен дозвіл у будь-який час у iOS Settings → Reflexia. Деякі функції (наприклад, запис голосового журналу) не працюватимуть без відповідного дозволу.

Застосунок не запитує: HealthKit, Геолокацію, Контакти, Календар, Motion & Fitness, Bluetooth, App Tracking Transparency (ми не виконуємо крос-app трекінг).

8. Оновлення, зміни та доступність

Ми можемо випускати оновлення Застосунку час від часу. Оновлення можуть додавати, змінювати чи видаляти функції та можуть вимагати останньої підтримуваної версії iOS. Можливо, вам доведеться встановлювати оновлення, щоб продовжувати користуватись Застосунком чи отримувати виправлення безпеки.
Ми можемо змінювати чи припиняти Застосунок, повністю або частково, у будь-який час — наприклад, з технічних, юридичних чи безпекових причин. Ми докладатимемо розумних зусиль для попередження про суттєві зміни заздалегідь.
Застосунок може бути тимчасово недоступним через обслуговування, технічні проблеми, перебої у третіх сторін (наприклад, перебій у AI-провайдера) чи події поза нашим розумним контролем. Локальні функції Застосунку (журнал, mood-трекінг) продовжуватимуть працювати навіть тоді, коли AI Insights недоступні.

9. Оплата

Застосунок наразі надається безкоштовно. У майбутньому ми можемо ввести платні функції, найімовірніше у формі підписки через App Store, щоб підтримати подальшу розробку та розблокувати додаткові можливості (наприклад, розширені AI-інсайти чи преміум-контент медитацій). Якщо ми це зробимо, додаткові умови, що стосуватимуться цих функцій, будуть представлені всередині Застосунку, і вам потрібно буде окремо їх прийняти перш ніж з вас стягнуть будь-яку оплату.

Функції, які зараз безкоштовні, залишаться безкоштовними. Ми не будемо ретроактивно переносити існуючу функціональність за пейволл, і ви завжди зберігатимете доступ до журнальних записів, mood-логів, аудіо/відео-записів та іншого контенту, який ви вже створили — з будь-якою майбутньою підпискою чи без неї.

Усі платежі за будь-які майбутні платні функції оброблятимуться Apple через App Store за стандартними платіжними умовами Apple. Ми не отримуватимемо вашу інформацію про картку чи банківський рахунок — див. Розділ 6.5 Політики конфіденційності щодо того, що ми бачимо й не бачимо про покупку.

10. Інтелектуальна власність

Застосунок і всі його компоненти — включно з вихідним кодом, інтерфейсом, дизайнами, логотипами, торговельними марками (включно з назвою та логотипом "Reflexia"), текстом, графікою, звуками, ілюстраціями, дихальними патернами, медитативними промптами та надихаючими цитатами, які ми відібрали та підготували — належать Reflexia чи нашим ліцензіарам і захищені законами про інтелектуальну власність.
За винятком обмеженої ліцензії в Розділі 3, жодні права на Застосунок вам не передаються.
Компоненти третіх сторін, включені до Застосунку (наприклад, open-source бібліотеки), ліцензовано за їхніми власними умовами, які ми поважаємо. Список цих компонентів та їхні ліцензії доступні за запитом.

11. Заборонена поведінка

На додаток до обмежень у Розділі 3, ви погоджуєтесь, що ви не будете і не дозволите жодній третій стороні:

використовувати Застосунок для порушення будь-якого закону чи нормативного акта;
видавати себе за іншу особу чи перекручувати свою приналежність до будь-якої особи чи організації;
використовувати Застосунок у спосіб, що міг би вимкнути, перевантажити чи завадити роботі наших систем чи систем третіх сторін;
намагатися отримати несанкціонований доступ до Застосунку, до будь-якого стороннього API чи даних інших користувачів (хоча інших користувачів на сервері немає, ви не повинні намагатися втрутитися в чийсь пристрій);
використовувати Застосунок для створення, зберігання чи передачі контенту, що експлуатує або наражає на небезпеку неповнолітніх;
використовувати Застосунок у будь-який спосіб, який, на наш розумний погляд, є шкідливим чи зловмисним.

Ми можемо призупинити або припинити ваш доступ до функцій (наприклад, дефолтного AI-провайдера), якщо ви порушите цей Розділ.

12. Умови Apple

Ці Умови — між вами та Reflexia, не з Apple Inc. Apple не відповідає за Застосунок чи його контент. Наступні умови застосовуються до вашого використання Застосунку та превалюють над будь-якими суперечливими положеннями деінде в цих Умовах:

Обсяг ліцензії. Ліцензія, надана вам у Розділі 3, обмежується непередаваною ліцензією на використання Застосунку на будь-якому iOS-пристрої, яким ви володієте чи контролюєте, як дозволяють Apple Media Services Terms and Conditions.
Обслуговування та підтримка. Reflexia несе виключну відповідальність за надання будь-якого обслуговування та підтримки Застосунку. Apple не має жодних зобов'язань надавати обслуговування чи підтримку.
Гарантія. У випадку будь-якого невідповідності Застосунку застосовній гарантії, ви можете повідомити Apple, і Apple може повернути вам ціну покупки Застосунку (якщо є). У максимальному обсязі, дозволеному законом, Apple не матиме інших гарантійних зобов'язань щодо Застосунку.
Претензії щодо продукту. Reflexia, а не Apple, відповідає за розгляд будь-яких претензій від вас чи третіх сторін щодо Застосунку, включно з (i) претензіями про відповідальність за продукцію; (ii) будь-якими претензіями, що Застосунок не відповідає застосовним правовим чи регуляторним вимогам; та (iii) претензіями за законодавством про захист споживачів, приватність чи подібним.
Інтелектуальна власність. У випадку будь-якої претензії третьої сторони про те, що Застосунок чи ваше володіння і використання порушують права інтелектуальної власності третьої сторони, Reflexia, а не Apple, нестиме виключну відповідальність за розслідування, захист, врегулювання та погашення будь-якої такої претензії.
Дотримання законів. Ви заявляєте та гарантуєте, що (i) не перебуваєте в країні під ембарго уряду США чи країні, визначеній урядом США як така, що "підтримує тероризм"; та (ii) не вказані в жодному списку заборонених чи обмежених сторін уряду США.
Третя сторона-бенефіціар. Ви визнаєте, що Apple та її дочірні компанії є третіми сторонами-бенефіціарами цих Умов, і що, прийнявши ці Умови, Apple матиме право (і вважатиметься такою, що прийняла це право) забезпечити виконання цих Умов проти вас як третя сторона-бенефіціар.

13. Відмова від гарантій

У максимальному обсязі, дозволеному застосовним правом, Застосунок надається "ЯК Є" і "ЯК ДОСТУПНО", без жодних гарантій, явних, неявних чи статутних.

Reflexia не гарантує, що:

Застосунок відповідатиме вашим вимогам;
Застосунок працюватиме без перерв, своєчасно, безпечно та без помилок;
результати, отримані з Застосунку, включно з AI-інсайтами, будуть точними чи надійними;
будь-які помилки в Застосунку буде виправлено.

Ви користуєтесь Застосунком на власний ризик. У межах, в яких жодна гарантія не може бути виключена згідно з законодавством про захист споживачів, наша відповідальність обмежена мінімумом, дозволеним цим законом.

14. Обмеження відповідальності

У максимальному обсязі, дозволеному застосовним правом, у жодному разі Reflexia, її афілійовані особи, посадові особи, працівники, агенти чи ліцензіари не нестимуть відповідальності за:

непрямі, випадкові, спеціальні, наслідкові, штрафні чи показові збитки;
втрату прибутку, доходу, гудвілу, даних чи можливості використання;
збитки, що виникли через ваше покладання на AI-інсайти чи інший контент у Застосунку;
збитки, що виникли через втрату даних, спричинену видаленням Застосунку, його скиданням, втратою пристрою чи відсутністю резервних копій,

навіть якщо Reflexia була попереджена про можливість таких збитків.

У максимальному обсязі, дозволеному правом, сукупна відповідальність Reflexia перед вами, що виникає з або пов'язана з Застосунком чи цими Умовами, не перевищить більшу з: (a) суми, яку ви сплатили нам за Застосунок протягом дванадцяти місяців, що передували події, яка спричинила відповідальність, чи (b) USD 50.

Жодне положення в цих Умовах не обмежує і не виключає: (i) відповідальності за смерть чи травму, спричинену недбалістю; (ii) відповідальності за шахрайство чи обманне введення в оману; (iii) будь-якої іншої відповідальності, яку не можна обмежити чи виключити за законом (включно, у деяких юрисдикціях, з правами споживачів).

15. Відшкодування збитків

Ви погоджуєтесь захищати та убезпечувати Reflexia та її афілійованих осіб, посадовців, працівників і агентів від будь-яких претензій, відповідальності, шкоди, збитків чи витрат (включно з розумними юридичними витратами), що виникають з або у зв'язку з: (a) вашим неналежним використанням Застосунку; (b) порушенням вами цих Умов; (c) порушенням вами будь-якого закону чи прав третьої сторони; (d) вашим Контентом. Цей Розділ не застосовується там, де він заборонений застосовним законодавством про захист споживачів.

16. Припинення

Вами. Ви можете припинити користування Застосунком і видалити його в будь-який час. Видалення Застосунку видаляє всі ваші локальні дані.
Нами. Ми можемо призупинити або припинити ваш доступ до Застосунку чи до конкретних функцій (наприклад, дефолтного AI-провайдера), якщо ви суттєво порушите ці Умови або якщо ми зобов'язані за законом. Де можливо, ми попередимо заздалегідь.
Розділи, які за своєю природою повинні пережити припинення — включно з Розділами 5 (Контент користувача), 10 (ІВ), 13 (Гарантії), 14 (Відповідальність), 15 (Відшкодування), 17 (Право, що регулює) та 18 (Інше) — продовжать діяти.

17. Право, що регулює, та вирішення спорів

Право, що регулює, та форум для цих Умов залежать від вашого місцеперебування.

17.1 Якщо ви перебуваєте у Сполучених Штатах

Ці Умови регулюються правом штату [US STATE — наприклад, Каліфорнія] та Сполучених Штатів, без урахування принципів вибору права чи колізійних принципів. Ви та Reflexia погоджуєтесь, що будь-який спір, що виникає з або стосується цих Умов чи Застосунку, буде вирішено виключно у штатних чи федеральних судах, розташованих у [US COUNTY, US STATE], і ви підкоряєтесь персональній юрисдикції цих судів. Ви погоджуєтесь, що будь-який спір буде розв'язано на індивідуальній основі, і ви відмовляєтесь від будь-якого права брати участь у груповому позові, у межах, дозволених законом. Ніщо в цьому Розділі не заважає будь-якій стороні шукати судової заборони чи іншого справедливого захисту в будь-якому суді відповідної юрисдикції для захисту своїх прав інтелектуальної власності.

17.2 Якщо ви перебуваєте за межами Сполучених Штатів

Ці Умови регулюються правом [GOVERNING LAW JURISDICTION — наприклад, України], без урахування його колізійних принципів. Будь-який спір буде розглянуто у компетентних судах [COURTS — наприклад, Києва, Україна], якщо інше не вимагається імперативними нормами права вашої країни проживання.

17.3 Захист споживачів (імперативні права зберігаються)

Якщо ви — споживач, що проживає в Європейському економічному просторі, Великій Британії, Швейцарії чи будь-якій іншій юрисдикції, що надає вам захист імперативних споживчих норм вашої країни проживання, ці імперативні норми продовжують застосовуватись і ці Умови не позбавляють вас їх. Ви можете подавати позови в суди країни проживання, і ми можемо подавати позови проти вас лише в судах країни вашого проживання.

17.4 Спочатку — неформальне вирішення

Перед поданням позову ви погоджуєтесь спробувати вирішити спір неформально, звернувшись до нас на reflexia.support@gmail.com. Ми спробуємо вирішити будь-який спір через добросовісні переговори протягом 60 днів з моменту вашого повідомлення. Якщо не зможемо, будь-яка сторона може подати позов, як зазначено вище.

18. Інше

Повна угода. Ці Умови разом із Політикою конфіденційності становлять повну угоду між вами та Reflexia щодо Застосунку.
Зміни. Ми можемо оновлювати ці Умови час від часу. Коли це відбувається, ми оновимо "Дата набуття чинності" та "Останнє оновлення" вгорі цього документа. Для суттєвих змін — таких як зміна категорій даних, що ми надсилаємо третім сторонам, введення платних функцій, нова юрисдикційна клаузула чи зміна, що суттєво зменшує ваші права — ми представимо оновлені Умови на екрані Consent при наступному запуску Застосунку та вимагатимемо повторного підтвердження прийняття перед продовженням користування зачепленою функцією. Для несуттєвих оновлень (типографічні правки, уточнення, організаційні зміни) продовження використання Застосунку після оновлення означає прийняття.
Подільність. Якщо будь-яке положення цих Умов визнано таким, що не підлягає виконанню, інші положення залишаються в повній силі.
Відсутність відмови. Невиконання положення не означає відмови від нашого права забезпечити його виконання пізніше.
Уступка. Ви не можете передавати свої права за цими Умовами без нашої попередньої письмової згоди. Ми можемо передати ці Умови афілійованій компанії чи у зв'язку зі злиттям, поглинанням чи продажем активів.
Форс-мажор. Жодна сторона не несе відповідальності за затримку чи невиконання, спричинене подіями поза її розумним контролем.
Мова. Ці Умови надаються англійською мовою. Перекладені версії наводяться для зручності; англійська версія має пріоритет у випадку розбіжностей, окрім випадків, коли застосовний закон вимагає інакше.
